We try to ensure that the information contained on our website and in our promotional material is accurate and up to date. However, supplier information can change and errors can regrettably occur. We reserve the right to amend and/or give notice to any changes at the time of booking and recommend that you undertake a level of independent research or speak to one of our experienced sales advisors should you wish to clarify any information.

  1. BOOKING AND PAYMENT SCHEDULE

1.1 Acceptance

Making a booking with the Company is taken as acceptance by the Client of these Terms and Conditions; These Terms and Conditions have been provided to the Client simultaneously with the booking form. By submitting a deposit or personal information, the Client agrees to be bound by these Terms and Conditions. In addition, these Terms and Conditions shall, unless otherwise provided, be deemed incorporated by reference into any additional agreement or contract for the booking of travel plans executed by the parties.  Once the booking form and initial deposit has been received and accepted by the Company, the booking is confirmed and the Client (s) becomes liable to make all payments for the trip and any cancellation or amendment fees that may subsequently arise.

1.2 Booking terms

Booking a safari is often an iterative process where we will have numerous discussions, and you will probably be provided with a number of different quotations with various options for Safari itineraries, locations, accommodation, etc. Once this process is completed and you are ready to proceed to book. In order to confirm our clients’ reservation, Luxury Africa Tours requires a 20% deposit payment at the time of making your booking.

1.3 Payment terms

  • Full payment is due no later than three (3) months prior to your departure.
  • Any bookings made within 8 weeks of the date of departure will require full payment at the time of booking.
  • The payments (deposit & final payments) may be made by Credit Card (Mastercard, Visa, American Express. Etc..) through a secure link, or via a bank wire/transfer. We will provide our banking details to facilitate this process. We reserve the right to pass on in full at any time increases in costs, including rates of exchange, for confirmed arrangements that may be introduced by suppliers or governing bodies (taxes and security fees, etc in this instance).
  1. CANCELLATION

2.1 Before the tour:

2.1.a. By the Client:

Cancellation and changes on the original booking must be confirmed by the person who made the booking and signing. Cancellation instructions by you must be in writing by email to us and will be deemed received on the day when we receive such instructions as provided.

Depending on when notification of cancellation is received, cancellation charges will apply as follows:

  • Cancellation 12 weeks prior to travel, deposit non-refundable
  • Cancellation prior to 8 weeks of travel – Full 30 % deposit is forfeited.
  • Cancellation 8 – 4 weeks prior to travel — 50% of the tour cost is fortified.
  • Cancellation less than 4 weeks prior to travel – 100% of the total cost is forfeited

Where we have informed you that a booking is non-cancellable, no refund will be made for cancellation, however, we will use reasonable commercial effort to try and obtain a measure of refund for you from the supplier and if successful will make such refund as we are able to obtain. Note that certain items such as gorilla and chimpanzee trekking permits are 100% non-refundable or non-transferrable.

We cannot give any allowance or refund for meals, accommodation, transport or other pre-paid services, not taken when these are included in the tour price nor once the tour has started. We don’t give any refunds for cancelling part of the tour.

CORONAVIRUS

We accept the government-imposed travel restrictions due to the COVID-19 pandemic. This constitutes a BONA FIDE reason to postpone. Therefore our guests will not forfeit any deposit. Instead, the deposit will be allocated to a future booking for the same tour, either on their own behalf or on behalf of any friends or family.

2.1.b By the Company:

It is unlikely we will have to change or cancel your Safari booking after it has been confirmed. However, as arrangements are often made many months in advance and we have no direct control over some of the products we feature, we reserve the right to change or cancel your Safari booking or a component of your booking at any time. Most changes tend to be minor and we will advise you of these as soon as possible.

If We Change Your Holiday Accommodation:

We do not control the day-to-day management of your accommodation, and in exceptional cases, it is possible that we may be advised that the reserved accommodation has been overbooked or your accommodation may have to be changed for other reasons. If this happens before your departure or on arrival in the resort, we will endeavor to provide accommodation of at least the same standard or higher in the same area at no extra cost incurred by the client. If only accommodation of a lower standard is available we will refund the difference between the accommodation booked and that available.

2.2 Cancellation on the tour

Most people go on holiday for rest and relaxation, so if in our reasonable opinion or in the opinion of, hotel manager, tour leader or another person in authority, informs us that your behavior is causing or is likely to cause danger, upset or damage to property or is persistently affecting the enjoyment of others, we reserve the right to terminate your holiday. Should this happen no refund or compensation would be paid and we will have no further responsibility for your holiday arrangements including return travel.

  1. Pricing Errors.

Whilst we make every effort to ensure the accuracy of the pricing information provided, regrettably errors may occasionally occur. When we become aware of any such error, we will endeavor to notify you at the time of booking (if we are then aware of the mistake), within 7 days of the time of booking or as soon as reasonably possible. If a booking is already in place, you will have the choice to continue with the chosen itinerary at the corrected price or amend to a different holiday. We reserve the right to cancel the booking if you do not wish to accept the price that applies to your holiday or any quoted alternatives.

  1. FORCE MAJEURE

In these Booking Conditions “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are likely to include war, or threat of war, terrorist activities, civil strife, riots, industrial action, disease, natural or nuclear disaster, fire, adverse weather conditions, closure of airports or ports, government action and all similar events. We cannot and do not accept liability where the performance or prompt performance, of our contractual obligations, is prevented by reasons of circumstance amounting to “force Majeure“. In the event of a cancellation or material alteration to the journey as a result of the circumstances as described in this clause, Luxury Africa Tours may in its sole and absolute discretion:

(i) Offer the client(s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances; or

(ii) If alternative travel arrangements or products are not offered by Luxury Africa Tours, we will provide a travel credit to the guest equal to the value of the trip less any sums Luxury Africa Tours is not able to recover from any supplier.

  1. Other Information

5.1 Personal Belongings and Lost Items

For security reasons, valuables should be kept to a minimum and packed in your hand luggage along with any medicines and some basic essentials such as a change of clothing and toiletries. It can be easy to lose items but it is your responsibility to look after your property at all times and you must ensure you are adequately covered by insurance to protect against any losses that you may wish to claim for. If you lose any personal items whilst on holiday, please obtain a written report from a local representative and the police, where appropriate, as these may be required if you wish to make an insurance claim upon your return. Where an airline has lost your luggage, you should visit the relevant desk at the airport and complete a Property Irregularity Report. This form may also be required if you wish to make an insurance claim.

5.2 Travel Insurance

We highly recommend all clients to subscribe to travel insurance covering cancellations or medical emergencies. 5.3 Conservation

It is becoming ever more important to conserve the world’s natural resources, its landscapes, flora and fauna. Someone coined the phrase “Take only photographs; leave only footprints” and a number of countries now use this to promote conservation. It would be hard to improve on this statement.
